Terms of Service

Welcome to To Keep The Hope Alive, a personal stories blog written by Hope ("the Service"), provided by Gillyware, LLC ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Use of the Service

  • Eligibility: You must be at least 13 years old to use the Service. If you are under 18, you may only use it under the supervision of a parent or legal guardian who agrees to these Terms.
  • Account Creation: Creating an account lets you comment and upvote. You are responsible for providing accurate information and for keeping your credentials confidential.
  • License: We grant you a non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.
  • Prohibited Activities: You may not use the Service for any unlawful or unauthorized purpose, or attempt to access, disrupt, or interfere with its systems or security.

2. Features

The Service lets you read stories and, with an account, post comments, upvote, subscribe to new-story email notifications, and make donations. Features may be added, modified, or removed at our discretion, with or without notice.

2a. Donations

  • One-Time Gifts: Donations are one-time, voluntary gifts processed via Stripe. By donating, you authorize the charge to your provided payment method. Stripe's processing is governed by their Terms of Service (opens in new tab).
  • No Subscriptions: We do not offer recurring or subscription billing.
  • Non-Refundable: Gifts are non-refundable except as required by law.
  • No Benefits: Donating is a gift of support and does not grant any additional access, rights, or membership.

3. Comments and Conduct

Comments you post are your "User Content." You retain ownership but grant us a worldwide, non-exclusive, royalty-free license to display, store, and process them to operate the Service. You agree to keep your comments respectful and lawful. We may remove comments or restrict accounts that are abusive, harassing, spam, or otherwise in violation of these Terms, at our discretion. You are responsible for the content you post.

4. Our Content

The stories, writing, images, and other material published on the Service are owned by Hope and/or Gillyware, LLC and are protected by copyright. You may read them and share links to them, but you may not copy, republish, or distribute them without our written permission.

5. Privacy and Your Rights

Our collection, use, and management of your data are governed by our Privacy Policy, incorporated into these Terms. You have rights to access, delete, and manage your data as outlined there.

6. Data Retention and Deletion

  • Account Deletion: Deleting your To Keep The Hope Alive account schedules your account data and comments for permanent removal within 90 days. You may delete it independently of your Gillyware account.
  • Gillyware Account Deletion: Deleting your Gillyware account also schedules your To Keep The Hope Alive data for deletion within the same 90-day window.
  • Cancellation: You may cancel a pending deletion by contacting us within the 90-day window. After this period, deletion is permanent.

7. Modifications to the Service

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any resulting changes or interruptions.

8. Termination

  • By You: You may stop using the Service and delete your account via the settings page or by contacting support.
  • By Us: We may suspend or terminate your access if you violate these Terms or for any reason at our discretion, without notice.

9. Disclaimer and Limitation of Liability

The stories shared on the Service are personal accounts and opinions offered for encouragement and reflection. They are not professional, medical, legal, financial, or other advice, and should not be relied upon as such. To the maximum extent permitted by law, Gillyware, LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claims is limited to the amount you paid us in the past 12 months, if any.

10. Indemnification

You agree to indemnify and hold Gillyware, LLC harmless from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes will be resolved in the state or federal courts of Florida, unless otherwise required by law.

12. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated through the Service. Continued use of the Service after updates constitutes acceptance.
